Unkillable process

I just noticed that a server daemon that I was running stopped,
and I wanted to manually kill it and relaunch it. The problem is that
I cant for some reason.  I've tried using killall -TERM and the name, I've
tried kill <pid>, nothing works...the process stays alive. Is there any
way to kill this thing without restarting my server?
