I think what Paul meant is they aren't releasing it under a "open" ie
GNU/BSD license. They are doing it more along the lines of Apple's Darwin.

Which leaves two codebases. one internal, one external. So you may edit
what they make publicly available, you submit back the patch, then Sun has
the option of applying that patch and including it in the next release..

It eliminates forking of the code, and protects their software product and
allows them to test it before the main releases. It has worked really well
for Apple from what I have seen. It allows a nice interaction between
developers and outside developers.

The major drawback is sometimes the codebases between releases can get
offtrack of each other.
